Negative results do not always indicate medical malpractice

Medical malpractice typically occurs when a doctor makes a negligent mistake. It could be a direct error, such as wrong-site surgery. It could also be an oversight, such as misdiagnosing a heart attack.

These mistakes often lead to negative results that cause harm to a patient. Someone’s condition might worsen, they could suffer an injury or they could even pass away from a preventable condition.

But the important thing to remember is that negative results are not always indicative of medical malpractice, and positive results will not happen in every single case. There needs to be an element of negligence or a demonstration that the medical professionals involved did not uphold the proper standard of care.

Not every case will be successful

For instance, say that a patient is suffering from a heart attack and needs emergency surgery. There is always going to be some element of risk with that type of procedure. Even if the surgeon does a perfect job, the patient could still pass away. It just depends on their own physical condition, how quickly they receive medical treatment and numerous other factors.

Conversely, however, say that the surgeon incorrectly diagnoses the condition and performs the wrong surgery. Had they carried out the correct procedure, the patient may have survived. Then it becomes medical malpractice, even though the result—the patient passing away—is the same in both cases.
